Paincare.ca Website Privacy Statement

This Privacy Statement ("Statement") applies to www.paincare.ca, a website owned and operated by Purdue Pharma Canada ("Purdue") out of Ontario, Canada ("Website"). Purdue may update this Statement to reflect a change in its practices from time to time. The date on which the Statement was last revised will be posted at the top of this page and users of the Website should always review the Statement if it has been revised since their last visit. In this Statement, "Personal Information" means information about an identifiable individual (a "natural person" rather than a corporation or other organization) that is collected through the Website and held by Purdue.

Collection of Personal Information: With the exception of the collection of internet protocol ("IP") addresses, which will be described below, Purdue does not collect Personal Information except when it is voluntarily provided by a user of the Website (referred to in this Statement as "user", "you", "your", "yourself"). By providing your Personal Information through the Website, you are consenting to its collection, use and disclosure by Purdue in accordance with this Statement, as it may be revised from time to time (and where applicable, to the transfer of the information to Ontario). If you do not consent to the collection, use and disclosure of your Personal Information in accordance with this Statement, as it may be revised from time to time, please do not provide Personal Information through the Website. Purdue will keep a record of the source of any Personal Information that it collects indirectly (from a source other than the person to whom the information relates). You represent to Purdue (and Purdue will rely on your representation), that you have obtained any required consent or are otherwise authorized to disclose any Personal Information about someone other than yourself that you provide to Purdue through the Website.

The Website uses "cookies", data files that are sent and stored on the hard drive of a user's computer, to collect information about traffic on the Website. The purposes for collecting such information, which includes the user's IP address, are to: ensure that the content of the Website displays correctly on the user's computer; monitor and log traffic on different pages of the Website to assess interest in Website content; and guide the design and content of the Website and related business decisions. An IP address is a series of numbers assigned to a computer by the user's internet service provider. An IP address may contain information that identifies a user; however Purdue does not link any of the information it collects through cookies with any Personal Information, including Personal Information that users have provided. Although you may be able to set your browser to reject cookies, some pages of the Website may not function properly if you do so.

Use and Disclosure of Personal Information: Purdue uses Personal Information to respond to or arrange for third parties to respond to inquiries and requests of users and to maintain, evaluate and improve the Website. Purdue may aggregate Personal Information (so that it cannot be linked to the person about whom it relates) to more effectively evaluate the use of the Website and for other business purposes.

There are a number of circumstances in which Purdue is permitted or required by law to disclose Personal Information without consent, for example, in response to a warrant, subpoena or order issued by a court, governmental or administrative authority with the power to compel the disclosure of the information, where there is a threat to an individual's health, safety or security, and in connection with an investigation into and/or the breach of a law or contract (including an investigation into suspected fraudulent, abusive or illegal activities on the Website). Without limiting the generality of the preceding, Purdue may disclose information about a user's usage of the Website to law enforcement authorities in connection with an investigation. Purdue may also disclose Personal Information to protect or manage its rights and property, including in connection with any reorganization (or contemplated reorganization) of its business and in connection with insurance coverage (including to make a claim).

Transfer of Personal Information to Service Providers: Purdue uses external service providers, including providers of information technology and other support services, who may require access to Personal Information to deliver their services. Where this is the case, Purdue requires the service provider to treat Personal Information in accordance with this Statement and to afford it the same degree of protection as does Purdue.

Links to Sites: As a matter of convenience for users, the Website contains links to other websites that are not owned or operated by Purdue. This Statement does not apply to the use and disclosure of personal information provided through linked websites and users should review the applicable policies and terms of use before using and providing their personal information through other websites.

Protection of Personal Information: Purdue uses a variety of technological and other means to protect Personal Information, including monitoring compliance with this Statement, however the Internet is not a secure means of transmitting information and users should not provide sensitive Personal Information, including without limitation personal health information, through the Website.

Access to and Correction of Your Personal Information: With limited exceptions, you may have access to your Personal Information. You may also request that Purdue correct your Personal Information. Requests for access and correction may be made as set out below and must be in writing.

By accessing and using www.Paincare.ca and the content on the website (together, the "Website"), you are deemed to have agreed to these terms and conditions of use (the "Terms of Use") and any other notices, guidelines and rules published by Purdue Pharma Canada ("Purdue") on this Website from time to time (each of which is incorporated by reference into and forms a part of these Terms of Use), and all applicable laws and regulations governing the Website. You also agree to the use of any personal information that you may provide to Purdue through this Website, as further described in the Privacy Statement posted on the Website. These Terms of Use apply exclusively to your use of this Website. T his Website is intended for use by residents of Canada who are healthcare professionals only. Accessing the Website from locations where its content is illegal is prohibited. Those who choose to access the Website from other locations do so at their own initiative and are responsible for compliance with local laws.

Purdue grants you a non-exclusive, non-transferable, non-sub-licensable, revocable, limited license to use (which includes, subject to section 2 of these Terms of Use, displaying on your computer, printing and downloading) the Website solely for your own personal, non-commercial use and for the purposes described in section 3 below. 9. Governing Law

This Website is controlled, operated and administered by Purdue from within the Province of Ontario, Canada. These Terms of Use will be interpreted and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario (other than any conflict of laws rules that would result in the choice of laws of another jurisdiction) and you agree to submit to the exclusive jurisdiction of the courts of Ontario in connection with any matter arising out of or relating to the Website or your use of the Website.
